Terms and Conditions

PLEASE READ THESE TERMS CAREFULLY. BY REGISTERING FOR, RECEIVING OR USING A CANPAY REWARDS LOYALTY ACCOUNT OR OTHERWISE PARTICIPATING IN A CANPAY GIFT CARD AND REWARDS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING WITHOUT LIMITATION, THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER INCLUDED BELOW, AND ANY ADDITIONAL TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT PARTICIPATE IN ANY CANPAY REWARDS PROGRAM.

General Application of Terms; Privacy

These Terms and Conditions (the “Rewards Terms“) apply to any access to and/or participation in the CanPay (“CanPay“) rewards programs (“CanPay Rewards“) existing now or in the future. These Rewards Terms are in addition to the Terms of Use, but only to the extent necessary to govern your participation in the CanPay Rewards. Capitalized terms not defined in these Rewards Terms will have the same meaning as in the CanPay Terms of Use. If these Rewards Terms are inconsistent with the Terms of Use, these Rewards Terms will govern your participation in the CanPay Rewards.

CanPay Rewards are offered at the sole discretion of the CanPay. Rules, terms, conditions, benefits or rewards may be modified at any time by CanPay with or without notice. Such changes may affect previously earned rewards.

Please read the Privacy Policy and Terms of Use carefully to understand how CanPay collects, uses and discloses information about its customers. These Rewards Terms do not alter in any way the terms or conditions of any other agreement you may have with CanPay for other products and services, or the terms or conditions of any other promotional offers or programs conducted by CanPay outside the context of CanPay Rewards.

Eligibility

CanPay Rewards is open to legal residents of the 50 United States of America, Washington, D.C., and Puerto Rico who are 18 years of age or older, and who have and maintain an active account through the website located at www.canpaydebit.com or the CanPay App and are in good standing. CanPay Rewards are intended for personal use only. Commercial use is prohibited. CanPay Rewards are not targeted toward, nor intended for use by, anyone under the age of 18.

CanPay reserves the right to terminate and disqualify you at any time from participating in CanPay Rewards if you don’t comply with these Rewards Terms.

How to Earn CanPay Rewards

We offer the ability for customers to earn CanPay Rewards on their purchases completed through the CanPay platform from the retailers, brands, merchants and other partners participating in this CanPay Rewards Program (“Affiliate Stores“). Participation in this Program and the opportunity to earn CanPay Rewards are offered at the sole discretion of CanPay and subject to your compliance with this Agreement.

You may accumulate CanPay Rewards for any qualifying purchase made on and after your date of enrollment in CanPay Rewards. To receive credit for a qualifying purchase and accumulate CanPay Rewards, you must present your digital CanPay Rewards account (i) at the point-of-sale at a participating U.S. CanPay participating merchant at the time of payment for a qualifying purchase transaction, or (ii) provided you are logged in to your account, at the time you place an order for a qualifying purchase through a participating merchant’s website.

In order to accumulate CanPay Rewards, qualifying purchases must be paid for using CanPay purchases using other currency, or promotional offers (such as redemption of a reward) will accrue CanPay Rewards only for the amounts, if any, paid via CanPay.

CanPay reserves the right to retroactively award CanPay Rewards not meeting these conditions in its sole discretion and only upon provision of a valid receipt by you regarding such purchase; however, CanPay Rewards will not be awarded for (i) purchases occurring prior to your enrollment in CanPay Rewards; or (ii) purchases made more than thirty (30) days prior to a request made to CanPay for such credit.

Some exclusions apply. Qualifying purchase as determined by merchant and approved by CanPay.

Where an eligible transaction is voided for any reason by any party, CanPay reserves the right to deduct the CanPay Rewards associated with that purchase from your account.

CanPay Rewards Programs

CanPay Rewards programs may be governed by additional terms, conditions, warranties, or representations issued by CanPay or Affiliate Stores (collectively and each individually, “CanPay Rewards Materials“). CanPay Rewards Materials may be made available on the CanPay platform. From time to time, CanPay and Affiliate Stores will offer special promotions. Information on the details, limitations, perks accumulation, and expiration of these special promotions will be included in CanPay Rewards Materials.

Each point is worth $0.0001 cent (e.g., 10,000 CanPay Rewards point is worth $1.00), which may be used towards eligible CanPay purchases.

CanPay Rewards may be subject to additional terms, conditions, restrictions or limitations, which may be disclosed in conjunction with the opportunity to redeem CanPay Rewards for such rewards, or added to these CanPay Rewards Terms from time to time.

How to Enroll

To enroll in CanPay Rewards and begin accumulating CanPay Rewards, participants must agree to these CanPay Rewards Terms, and comply with any CanPay Rewards Materials.

Registration may require you to provide your first name, last name, Quick Access PIN email address (required in order to receive all eligible rewards), mobile telephone number, and marketing preferences, and you may also elect to provide other information..

If you change your account country to one that is not located within the 50 United States or Washington D.C., your CanPay Rewards account will be deactivated. Once deactivated, you will no longer be able to accumulate CanPay Rewards or receive or redeem Rewards under your CanPay Rewards account. Previously credited CanPay Rewards and Rewards may also expire as described below.

You may have only one CanPay Rewards account registered to you, and additional CanPay Rewards accounts in your name or otherwise controlled by you may be deactivated by CanPay in its sole discretion.

Tracking Rewards

CanPay Rewards participants can view and track qualifying purchases and available Rewards by logging into participant’s account at app.canpaydebit.com. CanPay reserves the right to change the number of CanPay Rewards required to earn CanPay Rewards and/or the benefits associated with one or more CanPay Rewards in its sole discretion at any time. CanPay Rewards do not expire unless terminated as a result of an account being deactivated.

CanPay Rewards Redemptions

You may redeem any accrued CanPay Rewards at participated Affiliate Stores.

CANPAY MAY IN ITS SOLE DISCRETION EXHAUST CANPAY REWARDS BALANCES IN YOUR ACCOUNT TO OFFSET ANY AMOUNTS DUE TO CANPAY AT ANY TIME.

Special Offers

CanPay may from time to time in its sole discretion make available to participants in CanPay Rewards the opportunity to earn additional CanPay Rewards through special offers, challenges, bonuses or other promotions. The terms and conditions applicable to any such special offers will be determined by CanPay in its sole discretion and communicated to participants in conjunction with any such offers. Because any terms and conditions associated with any special offers under CanPay Rewards may be different from or in addition to provisions of these Rewards Terms, you should read any such special offer terms and conditions carefully before participating in any special offer.

Limitations, Restrictions, and Other Terms

  • Your CanPay Rewards account and any accumulated rewards are personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose. You may have only one CanPay Rewards account.
  • CanPay’s determinations of participant eligibility or any questions or disputes arising under the CanPay Rewards program, these Rewards Terms or any other CanPay Rewards program rules or restrictions shall be final and binding and not subject to challenge or appeal. Other than as set forth in the Dispute Resolution section of these CanPay Rewards Terms, nothing in these CanPay Rewards Terms will limit CanPay from exercising any legal or equitable rights or remedies that it may have.
  • Without notice to you, CanPay reserves the right to suspend and/or terminate any CanPay Rewards account and/or your participation in CanPay Rewards if CanPay determines in its sole discretion that you have violated these Rewards Terms, you have more than one CanPay Rewards account, or that the use of your CanPay Rewards account is unauthorized, deceptive, fraudulent, unlawful, or intentionally subverts the purposes of these Rewards Terms. CanPay may, in its sole discretion, suspend, cancel or combine accounts that appear to be duplicative. In the event that your participation in CanPay Rewards is terminated, then all accumulated CanPay Rewards and Rewards in your account are void.
  • There are no membership fees associated with CanPay Rewards, although use of online services in conjunction with participation in CanPay Rewards programs may result in data charges, internet access fees or similar expenses. Points and rewards accumulated under the CanPay Rewards program have no cash value and may not be redeemed for cash or sold, auctioned, bartered, brokered, purchased, transferred, assigned or used to engage in any gambling activity. Any rewards used or obtained in this manner by any person or entity may be confiscated or cancelled by CanPay at any time and for any reason.
  • CanPay may set expiration dates for the use of the CanPay Rewards and rewards accumulated under CanPay Rewards.
  • CanPay reserves the right to modify, amend or revise the rewards that are made available. The number of CanPay Rewards required to redeem any reward may be substantially increased, any reward may be withdrawn, and restrictions on any reward or its redemption may be imposed by CanPay.
  • CanPay is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail as a result of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including, without limitation, any resulting error in computing qualifying purchases or any unavailability of rewards, or any injury or damage to any participant’s or any other person’s computer or mobile device related to or resulting from participation in CanPay Rewards. If, for any reason, the CanPay Rewards program is not capable of running as planned, including due to errors of any kind or nature, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of CanPay which corrupt or affect the administration, security, fairness, integrity or proper conduct of any CanPay Rewards program, CanPay reserves the right in its sole discretion to cancel, terminate, modify, or suspend the CanPay Rewards program or otherwise respond to the circumstances as CanPay deems appropriate.

Changes to CanPay Rewards

CanPay reserves the right to change, update and/or discontinue, in whole or in part, either temporarily or permanently, CanPay Rewards or any portion of the program, all or any portion of these Rewards Terms, and/or any policy, FAQ, guidelines or disclosures pertaining to CanPay Rewards, at any time in its sole discretion and without advance notice to you or any other participants. CanPay will not be liable to you in the event of any modification, suspension or discontinuance of CanPay Rewards. Unless otherwise specified, any changes or modifications will be effective immediately upon posting the revisions to our terms, and you waive any right you may have to receive specific notice of such changes or modifications. If we change or modify the Rewards Terms, we will revise the “last updated” date located at the top of these Rewards Terms. If you continue to participate in the CanPay Rewards program by earning CanPay Rewards, redeeming CanPay Rewards, logging into your account or otherwise participating in the program in any way after a change to these Reward Terms, you will be deemed to have read, understood and unconditionally consented and agreed to such changes; therefore, you should review these Rewards Terms and applicable policies and FAQs frequently to understand the terms and conditions that apply to CanPay Rewards. If you do not agree to the Rewards Terms, you must stop participating in CanPay Rewards.

Additional Gift Card Terms

These terms and conditions apply to your purchase, receipt, or use of the CanPay e-gift cards (“CanPay eCards“). The terms and conditions are subject to change from time to time. Please refer to CanPay’s website (“Site“) located at www.canpaydebit.com for additional terms and conditions on your use of CanPay eCards, including CanPay’s Terms of Use and Privacy Policy.

1. Issuer. CanPay eCards are issued by Trusted Rewards, LLC (“Issuer“, “us” or “we“). The balance on any CanPay eCards is solely the liability of the Issuer.

2. General Terms. CanPay eCards:

  • Have no expiration date;
  • Have no fees;
  • Are not redeemable for cash, unless required by applicable law;
  • Are not reloadable; and
  • Are not a credit, debit, or reloadable prepaid card.

3. Redemption. You may only redeem CanPay eCards for use through the CanPay App. Promotional offers and discounts may not be applied towards the purchase of CanPay eCards.

4. View Your Balance. You can check your CanPay eCards balance by logging into the CanPay App at app.canpaydebit.com.

5. Risk of Loss. The risk of loss and title for CanPay eCards passes to you upon our or our authorized third party’s electronic transmission of the CanPay eCards to you or a designated recipient, if applicable. We are not responsible if any CanPay eCards are lost, stolen, destroyed or used without your permission.

6. Returns. You may not return or cancel your CanPay eCard after it is received. If you wish to cancel a CanPay eCards purchase order prior to its delivery to the designated recipient, you must contact us prior to the delivery date selected during the purchase process.

7. Non-refundable; non-transferable; not for resale. CanPay eCards are non-refundable, may not be transferred once redeemed, and may not be redeemed for cash, except where required by law. Resale of CanPay eCards is strictly prohibited.

8. Third Party Limitation of Liability. CANPAY AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO CANPAY ECARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A CANPAY ECARDS CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD BY PROVIDER. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

9. Delivery. If the date on which you want CanPay eCards delivered has passed and you have not received confirmation that the CanPay eCards was sent, please contact canpay@canpaydebit.com. Please refer to your order number, or be ready to supply the phone number linked to your account.

Neither we nor our third party provider such as Trusted Rewards LLC are responsible for CanPay eCards that are undeliverable or not received due to your failure to enter an accurate email address/phone number for the recipient. Please check to make sure the email address/phone number of the recipient is correct and contact us if you suspect the recipient did not receive her/his CanPay eCards. Should an email or text message be returned to us due to inaccurate delivery information for the recipient, we through our third party provider will attempt to contact you for a valid information.
